FAA tarkentanut 51% sääntöään, joka sulkee pois restauroinnin

EAA:n uutisissa oli maininta että USA:n FAA on tarkentanut sääntöjä sertifioitujen lentokoneiden osien käytössä harrasterakenteisessa koneessa ja tarkennus sanoo että tyyppisertifioidun koneen osien korjaus tai koneen kokonainen uudelleenrakennustakaan ei lasketa harrasterakenteisen (amateur built, 51%) säännön piiriin kuuluvaksi. Tämä lienee huonoja uutisia vanhojen lentokoneiden restauroijille. Onneksi tilanne ei näin kuitenkaan Suomessa ole:

"NOTE: A rebuilt, altered, or repaired type-certificated aircraft DOES NOT meet the intent of � 21.191(g) and DOES NOT meet the � 21.191(g) requirement that the major portion of the aircraft be fabricated and assembled."

In the past some people in the aviation community believed that by rebuilding or restoring entire aircraft or sections of a type-certificated aircraft, they could receive credit for the fabrication and assembly done.

Vanhan koneen uudelleenrakentaminen, joka on suuri huoltotoimenpide ja vaatii hyväksytyn organisaation, ei tarvitse täyttää harrasterakentamisen 51%:n sääntöä, mikäli koneyksilö täyttää Liite II:n historiallisen ilma-aluksen määritelmän:

a) ilma-alus, jolla on selkeä historiallinen merkitys, joka liittyy
i) osallistumiseen merkittävään historialliseen tapahtumaan, tai
ii) huomattavaan vaiheeseen ilmailun kehityksessä, tai
iii) merkittävään asemaan jäsenvaltion asevoimissa,

ja joka täyttää yhden tai useamman seuraavista perusteista:

i) ilma-aluksen alkuperäisestä tyyppisuunnittelusta on yli 40 vuotta;
ii) ilma-aluksen tyypin valmistaminen on lopetettu ainakin 25 vuotta sitten;
iii) jäsenvaltioissa on edelleen rekisteröitynä vähemmän kuin 50 alkuperäiseltä suunnittelultaan samanlaista ilma-alusta;


EASA:n Liite II muutosesitys vanhojen ja niihin rinnastettavien ilma-alusten osalta on seuraava:

ANNEX II
Aircraft referred to in Article 4(2) Aircraft to which Article 4(1), (1a) and (1b) do not apply are aircraft that are within one or more of the categories of this annex set out below:

(a) historic aircraft meeting the criteria below:

(i) non complex aircraft whose:
- initial design was established before 1.1.1955 and
- production has been stopped before 1.1.1975.
or
(ii) aircraft having a clear historical relevance, related to:
- a participation in a noteworthy historical event; or
- a major step in the development of aviation; or
- a major role played into the armed forces of a Member State.

(d)  aircraft that have been in the service of military forces, unless the aircraft is of a type for which a design standard has been adopted by the Agency;

(h) replicas of aircraft meeting the criteria of (a) or (d) above, for which the structural design is similar to the original aircra

Eli olennaista on USA:ssa (ja Suomessakin) huollon jälkeinen koneen status, onko kone harrasterakenteinen (51%:n sääntö) vai vanha ilma-alus koska se määrää koneelle huoltovaatimukset.
Mielestäni FAA ei ole kieltänyt restaurointia, se vain on tarkentanut että tälläistä vanhaa uudelleenrakennettua konetta ei hyväksytä harrasterakenteiseksi koska se luokitellaan heillä "Experimental - Exhibition" luokkaan.

Special Airworthiness Certificate

Experimental Category

A special airworthiness certificate in the experimental category is issued to operate an aircraft that does not have a type certificate or does not conform to its type certificate and is in a condition for safe operation.  Additionally, this certificate is issued to operate a primary category kit-built aircraft that was assembled without the supervision and quality control of the production certificate holder.

Special airworthiness certificates may be issued in the experimental category for the following purposes:

Research and development:  to conduct aircraft operations as a matter of research or to determine if an idea warrants further development.  Typical uses for this certificate include new equipment installations, operating techniques, or new uses for aircraft.

Showing compliance with regulations:  to show compliance to the airworthiness regulations when an applicant has revised the type certificate design data or has applied for a supplemental type certificate or field approval.

Crew training:   for training the applicant's flight crews in experimental aircraft for subsequent operation of aircraft being flight tested in type certificate programs or for production flight testing.

Exhibition:   to exhibit an aircraft's flight capabilities, performance, or unusual characteristics for air shows, motion pictures, television, and similar productions, and for the maintenance of exhibition flight proficiency.

Air racing:   to operate an aircraft in air races, practice for air races, and to fly to and from racing events.

Market surveys:   to conduct market surveys, sales demonstrations, and customer crew training for U.S. manufacturers of aircraft or engines.

Totta puhut, mutta exhibition luokka on niin käytöltään hyvin rajattu että se ei käytännössä ole vaihtoehto monelle,
ainakaan sen perusteella mitä ovat eräät tuttavat siitä valittaneet että exhibition-luokan koneilla
lentoja ei saa suorittaa kuin jollakin määritellyllä kentällä ja silläkin rajallisesti + siirtolentoja johonkin lentonäytökseen tms., mutta ei muita matkalentoja, huvilentoja jne.,
idea on kuulemma vaan että voi harjoitella lentonäytöstä sekä lentää lentonäytöksessä, ei muuta. Itse en kyllä katsoisi esim. Jämillä kerran kesässä käyntiä
lentokoneen omistamisen väärtiksi.
